Notice of Implementation of the New Scheduling Conflicts Procedure

This is a reminder that the new scheduling conflicts procedure takes effect today, January 2, 2019.  Updated versions of the Guide to Oral Argument (pdf) and the Response to Notice to Advise of Scheduling Conflicts form (pdf) are available on our website.  Counsel should begin using this new form when advising the court of scheduling conflicts.  For more information on the revised procedure, see our December 10, 2018 notice (pdf).

Notice of New Mandate Format

Beginning January 2, 2019, the court will begin using a new format for its mandates. Litigants, members of the bar, and the public may notice a change in the format of this item on the court’s docket as of that date.  

Revised Scheduling Conflicts Procedure

Beginning January 2, 2019, the court will be changing its argument scheduling practices in an effort to reduce further the time between when a case is calendar-ready and is scheduled for oral argument.  Full details of this change can be found here (pdf).

Revised Brief and Appendix Filing Procedures

On December 1, 2018, the Clerk’s Office will implement two changes to its filing procedures for briefs and appendices: (1) discontinuation of the brief “tendering” practice and (2) deferment of filing of paper copies pursuant to new amendments to the Federal Circuit Rules of Practice.  Please see the new Information Sheet: Revised Brief and Appendix Filing Procedures (pdf) for information on how to file briefs and appendices under the new procedures.

Notice of Final Amendments to the Federal Circuit Rules of Practice

The United States Court of Appeals for the Federal Circuit has adopted amendments to Federal Circuit Rules of Practice 25, 28, 29, 30, 31, 32, and 44.  The final notice, order of adoption, and adopted amendments are available here (pdf).

These new rules apply to all cases and documents filed on or after December 1, 2018.  On November 30, 2018, a revised version of the Federal Circuit Rules of Practice and Federal Rules of Appellate Procedure will be on the court’s website.  Please direct any questions to the Clerk’s Office at 202-275-8055 or chiefdeputyclerk@cafc.uscourts.gov
