On October 3, 2005, the Federal Circuit established an appellate mediation program pursuant to Federal Rule of Appellate Procedure 33. Pursuant to Federal Circuit Rule 33.1, the court has adopted Appellate Mediation Program Guidelines (pdf).
The program is administered by the Circuit Executive, with the Office of General Counsel conducting case screening to identify eligible cases. Once identified, cases are referred to one of the Federal Circuit’s volunteer mediators. The Circuit Executive annually reports Circuit Mediation statistics at the end of the calendar year.
