Beginning January 2, 2019, the court will be changing its argument scheduling practices in an effort to reduce further the time between when a case is calendar-ready and is scheduled for oral argument. Full details of this change can be found here (pdf).
The new edition of the Federal Circuit Rules of Practice is available on the court’s website (pdf). The Electronic Filing Procedures have also been updated regarding revised procedures for briefs and appendices. These procedures are available on the court’s website (pdf).
On December 1, 2018, the Clerk’s Office will implement two changes to its filing procedures for briefs and appendices: (1) discontinuation of the brief “tendering” practice and (2) deferment of filing of paper copies pursuant to new amendments to the Federal Circuit Rules of Practice. The United States Court of Appeals for the Federal Circuit has adopted amendments to Federal Circuit Rules of Practice 25, 28, 29, 30, 31, 32, and 44. The final notice, order of adoption, and adopted amendments are available here (pdf).
These new rules apply to all cases and documents filed on or after December 1, 2018. On November 30, 2018, a revised version of the Federal Circuit Rules of Practice and Federal Rules of Appellate Procedure will be on the court’s website. The Clerk’s Office has released updated electronic filing procedures (version 2.2) to coincide with changes to the argument notification process. Effective December 1, 2018, the Clerk’s Office will discontinue its brief and appendix tendering process to allow instead for briefs to be considered filed as of the moment they are submitted through CM/ECF. Click here (pdf) for the full notice and information about the new procedure.
Effective October 22, 2018, the Clerk’s Office will begin issuing revised versions of its notices for cases scheduled for oral argument, for cases submitted without oral argument, and for counsel to advise of scheduling conflicts for oral argument.
