Before contacting the Clerk’s Office, filers should review whether there is a current system outage or extended maintenance window. Depending on the nature and anticipated length of an outage, the Clerk’s Office may extend electronic filing deadlines under Federal Circuit Rule 26(a)(4).
Filers experiencing individualized technical or system errors on their end outside of Clerk’s Office operating hours that should follow the requirements of Federal Circuit Rule 25(c)(1)(C) for filing a motion for leave to file out of time in lieu of contacting the Clerk’s Office emergency line.
