The United States Court of Appeals for the Federal Circuit will be closed on Monday, January 18, 2021, in observance of Martin Luther King Jr.’s Birthday, pursuant to Federal Rule of Appellate Procedure 26(a)(6), and on Wednesday, January 20, 2021, in observance of Inauguration Day, pursuant to 5 U.S.C. 6103(c). For purposes of computation of time and motions to enlarge time under Rule 26 of the Federal Rules of Appellate Procedure and Federal Circuit Rules, January 20, 2021, will be considered a “legal holiday.” The full order is available on the court’s website (pdf).
All electronic filing deadlines for Monday, January 18 are now due on Tuesday, January 19, and all electronic filing deadlines for Wednesday, January 20 are now due on Thursday, January 21. Electronic filing deadlines for Tuesday, January 19 remain unchanged. The court hearing scheduled for January 19, 2021, will proceed as scheduled.
The Clerk’s Office will also be inaccessible for purposes of receiving paper filings, mail and courier deliveries, and night box submissions on January 19, 2021. See Federal Circuit Rule 26(a)(3). Deadlines for nonelectronic filings and submissions due on either January 18, 19, or 20 will be deemed as timely filed if received on Thursday, January 21, 2021.
