An updated version of the Federal Circuit Rules of Practice is now available on the court’s website (pdf). The update incorporates the December 1, 2021 amendments to Federal Rules of Appellate Procedure 3 and 6, which do not impact the Federal Circuit’s local rules or procedures.
The United States Court of Appeals for the Federal Circuit and the U.S. Court of Federal Claims have entered a new joint order modifying and superseding their prior administrative order of July 31, 2021, concerning access to the National Courts Building complex in Washington, D.C. Courthouse access will continue to be limited to court staff and litigants, witnesses, and any other parties who will be physically present in the courthouse because of their participation in a scheduled hearing that day. Additional requests for access will still be handled on a case-by-case basis when submitted in writing at least 24 hours ahead of time. Requests for access relating to Federal Circuit business or spaces within the National Courts Building may be submitted in writing through the Facilities and Security Office. These restrictions will remain in effect until further notice.

The United States Court of Appeals for the Federal Circuit will be closed on Friday, November 26, 2021, in addition to the federal holiday of Thursday, November 25, 2021. For purposes of computation of time and motions to en-large time under Federal Rule of Appellate Procedure 26 and Federal Circuit Rule 26, November 26, 2021, will be considered a “legal holiday.” The full order is available on the court’s website (pdf).
The U.S. Court of Appeals for the Federal Circuit is pleased to announce today’s release of its new website at https://www.cafc.uscourts.gov. Over the past several months, the court has been working diligently to develop the site while creating new content and enhancing the overall user experience through improved site layout and functionality.
Included in the new website are quick reference icons on the main page to frequently visited content; expanded searches for court opinions and orders, court statistics, and audio recordings of oral arguments; and a streamlined method for communicating with the court. Case participants and counsel can now access expanded resources and information about filing with the court and the different stages of the appellate process under new Case Information and Oral Argument menus. A new Information For… menu directs visitors to audience-specific content sections, including new public civic education content and resources as part of the federal judiciary’s ongoing initiative to expand public digital civic engagement opportunities.
During a private ceremony held in chambers this afternoon at the National Courts Building in Washington, D.C., Tiffany P. Cunningham was sworn in as a United States Judge for the Court of Appeals for the Federal Circuit. Chief Judge Kimberly A. Moore administered the oath of office to Judge Cunningham, which was witnessed by several of the court’s judges, as well as personal guests of Judge Cunningham.

Judge Cunningham was nominated by President Joseph R. Biden on April 19, 2021, and the United States Senate confirmed her nomination on July 19, 2021. She received her judicial commission on August 6, 2021. Judge Cunningham’s full biography is available on the court’s website.

The U.S. Court of Appeals for the Federal Circuit has issued Revised Protocols for In-Person Argument (pdf) that will apply for the September 2021 court sitting and subsequent sittings until further notice. Based on the Revised Protocols, the court has also updated the Certificate of Compliance (pdf) required ahead of time for all arguing counsel, as well as implemented an additional certification requirement on the day of argument for everyone participating in the argument. The Clerk’s Office will be individually notifying counsel scheduled for September’s session of these new requirements.
