Notice of Final Amendments to the Federal Circuit Rules of Practice

Pursuant to 28 U.S.C. § 2071(b), the United States Court of Appeals for the Federal Circuit has adopted amendments to Federal Circuit Rules of Practice 1, 3, 4, 5, 8, 10, 11, 12, 15, 17, 18, 21, 24, 25, 25.1 (new rule), 26, 26.1, 27, 28, 28.1, 29, 30, 31, 32, 32.1, 33, 33.1, 34, 35, 36, 39, 40, 41, 45, 46, 47, 47.2, 47.3, 47.4, 47.5, 47.7, 47.9, 47.10, 47.12, 50, 52, and 54, and the Federal Circuit Attorney Discipline Rules.  These amendments take effect on July 1, 2020, and will apply to all cases filed or pending on or after July 1, 2020, to the extent practicable, unless otherwise ordered.  

The final public noticethe order of adoptiona draft copy of the new Federal Circuit Rules of Practice, and a summary of the adopted amendments are available on the court's website.  Edits and corrections to the draft proof copy may be submitted to the Clerk's Office at FederalCircuitRules@cafc.uscourts.gov by the close of business on June 23, 2020. The Clerk's Office will issue a final version of the Federal Circuit Rules of Practice on June 30, 2020. [June 16, 2020]
